Notice of Public Comment - Revision to Volatile Organic Compound (“VOC”) Emissions Standards for Consumer Products and Technical Corrections

Notice is hereby given that a public hearing will be held on Monday, November 9, 2026, at 5:30 pm. The public hearing will be held using teleconferencing, which allows for both a video and voice over internet protocol (VOIP) connection:

This hearing provides interested parties an opportunity to comment on the District of Columbia's ("District") proposed Revision to Volatile Organic Compound ("VOC") Emissions Standards for Consumer Products and Technical Corrections published on Friday, August 28, 2026. 73 DCR 12156. The hearing also provides an opportunity to comment on the inclusion of the proposed rule in the District’s State Implementation Plan (“SIP”). 

The intent of the proposed rulemaking is to reduce VOC emissions from consumer products in the District. Through this rulemaking, the District proposes to incorporate the Ozone Transport Commission’s 2010 Consumer Products Phase III and 2012 Consumer Products Phase IV model rules. The proposed rulemaking: 

  • Amends the Table of Standards in § 720 to add new regulated categories of consumer products and updatesVOC limits and effective dates; 

  • Consolidates and expands the product category-specific requirements in § 725; 

  • Replaces outdated sell-through provisions with new ones for the added categories;

  • Updates the definitions in § 799; and 

  • Makes clarifying and technical corrections.

Once final, the Department of Energy and Environment ("DOEE") will submit the rulemaking to the U.S. Environmental Protection Agency ("EPA") as an amendment to the District's SIP (found at 40 CFR Part 52, subpart J).

DOEE is also extending the public comment period for written comments to align with the date of the hearing.  Interested parties may submit written comments to the same DOEE address or the same email by 4:00 pm on Tuesday, November 9, 2026. Testimony presented at the public hearing will also be entered into the comment record. The record closes at the conclusion of the public hearing, and no comments will be accepted after that time.
